WilliamDavid (Pty) Ltd Terms and Conditions
Introduction
By clicking “I Agree” or using our services, you agree to be bound by these Terms and Conditions. WilliamDavid (Pty) Ltd (Reg Number 2016/299539/07), trading as WilliamDavid, is a travel agency that arranges travel services through third-party suppliers. Please read these terms carefully before making a booking. By agreeing to these terms, you confirm that you are above the age of 18, the legal age of contracting in South Africa.
- Validity of Quotation
1.1 WilliamDavid cannot guarantee any price or fare quoted for any length of time. Packages, seats, and booking classes can sell out and prices may increase. Prices may also vary due to availability, exchange rates, and taxes.
1.2 To secure your quoted price, payment in full is required. A non-refundable deposit of R250 per person is required for a flight itinerary, which will be used towards your flight when full payment is made. WilliamDavid charges a fair and reasonable service fee to book travel on your behalf.
- Payment Options
2.1 Payments can be made via:
– Cash: Always insist on a receipt.
– Credit card and debit cards.
– Online payment link (electronic customer acceptance). Secure online payment by credit card where Terms & Conditions and booking details can be accepted.
– Electronic transfer: Please ask your travel consultant for bank details and notify your consultant once the EFT has been actioned. Your travel documents cannot be released until the transfer reflects in our bank account.
2.2 WilliamDavid does not accept cheques.
2.3 The cost of your product or service could increase due to demand, supplier rulings, and exchange rate increases in the time it takes for your transfer to reflect. All increases will need to be paid by you. If the product is not available at the time your deposit reflects, your money will be refunded.
- Cancellation Policy
3.1 Cancellation penalties will apply, depending on when you cancel, the supplier’s cancellation policy, and the fare rules. These fees can be as much as 100%.
3.2 WilliamDavid will charge an administration fee for processing the cancellation of your booking. Refunds by airlines will take a minimum of 12 weeks. If you do not make your flight or arrive late, you will be marked as a no-show and will lose your flight and any possible refund.
- Changes to Booking
4.1 Whether you can change your booking depends on the rules of your ticket or the third-party supplier’s rules.
4.2 Airlines do not permit name changes, and travel arrangements are not transferable.
4.3 Third-party suppliers usually charge a fee for changing your booking. WilliamDavid will charge an administration fee. All changes must be agreed to in writing by you, and all fees relating to the change will be payable by you.
- Responsibility for Travel Booking
5.1 Your travel is booked through suppliers and tour operators for air transport, land accommodation, adventure tours, insurers, visa suppliers, forex suppliers, and car rental companies.
5.2 Third-party suppliers are the providers of your travel and have their own terms and conditions. WilliamDavid acts as an agent and cannot be held responsible for the acts, omissions, negligence, or gross negligence of any third-party suppliers.
5.3 WilliamDavid will endeavor to assist clients at all times. Suppliers and WilliamDavid cannot be held responsible for cancellation or postponement of travel due to factors outside of their control, such as acts of God, weather, mechanical failure, riots, financial failures, strikes, political uprisings, etc.
- Travel Insurance
6.1 Travel insurance is highly recommended and should be purchased at the time of initial payment or deposit.
6.2 International travel insurance is especially recommended, as international operators are not bound by South African Consumer laws or any other applicable laws. Travel insurance should be purchased when the final payment is made. Copies of travel insurance policies are available from WilliamDavid.
- Pre-Travel Checklist
7.1 Check your departure, return, and connecting flights with the airline at least 24 hours before departure. Schedule changes by airlines are outside of WilliamDavid’s control.
7.2 Ensure the correct personal information, as well as dates and times of travel, are provided.
7.3 Passports must be valid for at least six months after the date of return. Travel documents must be in the name appearing on your passport.
7.4 South African permanent residents traveling on a foreign passport must have the right documentation from Home Affairs.
7.5 Dual passport holders should travel with both valid passports.
7.6 For domestic travel, all travel documents must match the name on your identity documents, and identification is required for infants.
7.7 Children require unabridged birth certificates for international travel. If traveling with one parent, consent in the form of an affidavit from the other parent is required, along with the unabridged birth certificate. If traveling with no parents, consent from both parents is needed.
7.8 Always take your South African driver’s license along with your international driver’s license when renting vehicles overseas. The driver must have a valid credit card when collecting the vehicle.
7.9 It is the client’s responsibility to check visa requirements with the consulate or embassy of each country being visited, including stopovers/ports and transits.
7.10 Check with your travel doctor or the relevant embassy which vaccinations are required by the country you are visiting and returning to.
7.11 Ensure your travel documents match your itinerary and know your travel plan.
- Complaints and Disputes
8.1 If you are not satisfied with the services offered by WilliamDavid or any third-party service provider, address your complaint in writing to our Customer Care Department at info@williamdavid.co.za.
8.2 Inform us immediately if you are not satisfied with any service to enable us to resolve the problem. Your right to compensation may be reduced if you do not give us the opportunity to resolve a problem.
8.3 Third-party claims can be sent to WilliamDavid Customer Care, but some claims may have to be made directly with the supplier. Claims against WilliamDavid must be directed to the manager immediately and no more than four weeks after your trip. Stolen luggage must be reported to the airline before leaving the airport.
8.4 WilliamDavid is not responsible for death, personal injury, damages, or losses occurring through the provision or omission of a service or product from a third-party supplier.
8.5 WilliamDavid cannot guarantee the safety standards or satisfactory performance of any supplier. Any travel booked is considered with your approval and consent to the conditions attached.
- Consumer Protection and POPI Act
9.1 Under the Consumer Protection Act, you have the right to receive timely, quality service and accurate information about the services you purchase.
9.2 WilliamDavid will take reasonable measures to protect your personal information as required by the Protection of Personal Information (POPI) Act. Personal information will only be processed for legitimate business purposes and as agreed upon by you.
9.3 You have the right to access and correct your personal information held by WilliamDavid.
- Indemnity
10.1 You agree to indemnify and hold WilliamDavid harmless from any claims, damages, losses, or expenses arising out of your use of our services and any third-party services arranged on your behalf.
10.2 This indemnity includes, but is not limited to, any claims relating to travel disruptions, cancellations, delays, or any other issues caused by third-party suppliers.
- Force Majeure
WilliamDavid will not be liable for any failure to perform any obligation under these Terms and Conditions if the failure is due to events beyond our reasonable control, including but not limited to acts of God, war, civil disturbance, strikes, natural disasters, pandemics, or interruptions in transportation or communication facilities.
- Governing Law
12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of South Africa.
